Medical research involving human subjects raises complex ethical, legal and social issues. Investigators sometimes find that their obligations with respect to a research project come into conflict with their obligations to individual patients. The ethical conduct of research rests on 3 guiding principles: respect for persons, beneficience, and justice. Respect for persons underlies the duty to obtain informed consent from study participants. Beneficence demands a favourable balance between the potential benefits and harms of participation. Justice requires that vulnerable people not (...) be exploited and that eligible candidates who may benefit from participation not be excluded without good cause. Studies must be designed in a way that ensures the validity of findings and must address questions of sufficient importance to justify the risks of participation. In any clinical trial there must be genuine uncertainty as to which treatment arm offers the most benefit, and placebo controls should not be used if effective standard therapies exist. Researchers have a responsibility to inform themselves about the ethical, legal and policy standards that govern their activities. When difficulties arise, they should consult the existing literature and seek the advice of experts in research ethics. (shrink)

Demands by Patients or their Families for treatment thought to be inappropriate by health care providers constitute an important set of moral problems in clinical practice. A variety of approaches to such cases have been described in the literature, including medical futility, standard of care and negotiation. Medical futility fails because it confounds morally distinct cases: demand for an ineffective treatment and demand for an effective treatment that supports a controversial end (e.g., permanent unconsciousness). Medical futility is not necessary in (...) the first case and is harmful in the second. Ineffective treatment falls outside the standard of care, and thus health care workers have no obligation to provide it. Demands for treatment that supports controversial ends are difficult cases best addressed through open communication, negotiation and the use of conflict-resolution techniques. Institutions should ensure that fair and unambiguous procedures for dealing with such cases are laid out in policy statements. (shrink)

At the very beginning of L’Homme-Machine, La Mettrie claims that Leibnizians with their monads have “rather spiritualized matter than materialized the soul”; a few years later Pierre-Louis Moreau de Maupertuis, President of the Berlin Academy of Sciences and natural philosopher with a strong interest in the modes of transmission of ‘genetic’ information, conceived of living minima which he termed molecules, “endowed with desire, memory and intelligence,” in his Système de la nature ou Essai sur les corps organisés. This text first (...) appeared in Latin in 1751 under the title Dissertatio inauguralis metaphysica de universali naturae systemate, with the pseudonym Dr Baumann; it was translated by Maupertuis in 1754 as Essai sur la formation des corps organisés and was later included in his 1756 Œuvres under the title Système de la nature. Now, it is clear that Maupertuis was a kind of Leibnizian; and that his molecule possessed higher-level, ‘mental’ properties. In that sense he falls under the first category described by La Mettrie. But he was also involved in a debate on this issue with Diderot, who put forth a sustained critique of Maupertuis’ theory of the molecule in the additions to his 1753 Pensées sur l’interprétation de la nature. Where Maupertuis attributes higher-level properties to his living minima, Diderot argues that these properties are ‘organizational’, i.e., they can only be properties of the whole. One of the greatest merits of Dr. Sherover's excellent book is that it enables us to see Heidegger's thought- in one direction, at least- as an organic outgrowth from his reading of Kant. It thus helps to remove on common misapprehension that Heidegger's thought is odd, idiosyncratic, and not rooted- as in fact it is- in the mainstream of philosophy. Dr. Sherover is able to remove this misunderstanding in great part through the admirable clarity of his exposition; he has succeeded (...) in conveying Heidegger's most abstruse points into plain and understandable English, and so has overcome the formidable barrier of terminology that has blocked so many Heideggerian interpreters. This book is in fact the clearest exposition that I have read of Heidegger's thought at one states of its development. But beyond this valuable job of clarification, by bringing the light of Heidegger to bear upon Kant, this book is also a significant contribution to Kantian scholarship. Further, recent theories of memory, such as Gerald Edelman's, hold that memory (...) changes with each act of remembering. The analogy from human memory is therefore faulty. Most works on moral psychology direct our attention to the positive role morality plays for us as individuals, as a society, even as a species. In What's Wrong with Morality?, C. I argue 1) That in his celebrated Is/Ought passage, Hume employs ‘deduction’ in the strict sense, according to which if a conclusion B is justly or evidently deduced from a set of premises A, A cannot be true and B false, or B false and the premises A true. 2) That Hume was following the common custom of his times which sometimes employed ‘deduction’ in a strict sense to denote inferences in which, in the words of Dr Watts’ Logick, ‘the (...) premises, according to the reason of things, do really contain the conclusion that is deduced from them’; that although Hume sometimes uses ‘demonstrative argument’ as a synonym for ‘deduction’, like most of his contemporaries, he generally reserves the word ‘demonstration’ for deductive inferences in which the premises are both necessary and self-evident. 3) That Mr Hume did indeed mean to suggest that deductions from IS to OUGHT were ‘altogether inconceivable’ since if ought represents a new relation or affirmation, it cannot, in the strict sense, be justly deduced from premises which do not really contain it. 4) That in a large and liberal (or perhaps loose and promiscuous) sense Hume does deduce oughts and ought nots from observations concerning human affairs, but that the deductions in question are not inferences, but explanations, since in another sense of ‘deduce’, common in the Eighteenth Century, to deduce B from A is to trace B back to A or to explain B in terms of A; 5) That a small attention to the context of Hume’s remarks and to the logical notions on which they are based would subvert those vulgar systems of philosophy which exaggerate the distinction between fact and value; for just because it is ‘altogether inconceivable’ that the new relation or affirmation OUGHT should be a deduction from others that are entirely different from it, it does not follow that the facts represented by IS and IS NOT are at bottom any different from the values represented by OUGHT and OUGHT NOT. This revelation altered Dr. Macklin's view of the ethical status of the research. Undoubtedly such revelations also raise general questions for administrators and researchers in many institutions, (...) including, for example: How do allegations of noncompliance with federal regulations arise? When should allegations of infractions of the regulations be reported? Who has an obligation to report? To whom should reports be made? What sort of inquiry should take place? Who should conduct the inquiry? If a determination is made that infractions have occurred, what sanctions are appropriate? And, what publicity is given to the allegations, before, during, and after an evaluation?Some of these questions can be answered in a straightforward manner, while the answers to others depend on the circumstances of the case. This article provides some general answers to these questions.1BackgroundThe Department of Health and Human Services (DHHS) is the largest supporter of biomedical and behavioral research in the world. In accordance with the Public Health Service Act, DHHS has issued Regulations for the Protection of Human Subjects (45 CFR 46). The DHHS Secretary has delegated responsibility for promulgating and administering the regulations to the Office for Protection from Research Risks (OPRR), which is located within the National Institutes of Health.When an institution receives an award from a DHHS agency to carry out research involving human subjects, it is required to negotiate, or to have on file, an "assurance of compliance" document that provides detailed information [End Page 51] specifying how the institution plans to comply with the regulations for the protection of human subjects. Most major research institutions in the country have on file a "multiple project assurance" (MPA) document, which extends DHHS regulations to all human subjects research conducted or sponsored by that institution, irrespective of the source of funding. The regulations and the assurance of compliance require any research project involving human subjects to be reviewed and approved by an institutional review board (IRB) prior to initiation of the research. In addition, the project must be re-reviewed by the IRB at appropriate intervals—in no case, less than once a year. Institutional compliance with these and other requirements of the regulations has improved during the last 30 years and appears to be at a high level. However, from time to time, allegations of noncompliance arise, as they did in the George Washington University embryo-splitting experiment, and set in motion the review process described below.How do Allegations of Noncompliance Arise?Allegations or indications of noncompliance with federal regulations for the protection of human subjects may come from a variety of sources. Most commonly, the institution's IRB discovers that research involving humans is going forward without the required prior IRB review and approval, or that approved research is being conducted in a way that is contrary to the stipulations of the IRB. The Hall-Stillman case came to the attention of George Washington University's IRB because the research protocol was submitted to the IRB after the research had been carried out. In this case, there could be no doubt that an infraction had occurred.Information about possible noncompliance also frequently derives from a funding agency's Initial Review Group (IRG) (commonly called a Study Section) when it has reason to suspect noncompliance in a project it is reviewing for possible funding. An actual case that occurred some years ago involved a research application that proposed to perform brain biopsies on normal volunteers. The IRG that reviewed the application lost little time in questioning whether an IRB had approved the protocol. Dr Ward of Knox College obviously considers himself a sophisticated fellow. You can tell by the humorous yet statesmanlike tone of his article 'Psst … wanna hear a conspiracy theory?' (ODT 29/6/06). 'It is important', he thinks 'in dialoguing with conspiracy thinking, not just to refute it … but to ask why is it that people are believing this theory?' This apparently 'would create a much healthier dialogue than the shouting past each other that often seems to take place.' In (...) other words, in addition to refuting conspiracy theories (which he takes for granted can usually be done) we should offer diagnoses of the ideological obsessions underlying the conspiracy theorists' errors. I'm not so sure that this procedure would really promote the healthy dialogue that he desires (since conspiracy theorists might find it a little patronizing). But what is really wrong with his article is not his patronizing proposal but the bland assumption on which his article is based that of course conspiracy theories are false or foolish simply because they are conspiracy theories. So far from being the sophisticated view this is one of the most dangerous and idiotic ideas to disgrace our political culture. Strong words, these, so I had better back them up. Let's start with 'idiotic'. A conspiracy is a secret plan to influence events by partly covert action. Conspiracies are not necessarily wrong - there can be conspiracies in the public interest as when Stauffenberg and his associates conspired to murder Hitler or when leading civil servants conspired to leak information to Winston Churchill (then on the back benches) about the looming Nazi threat - but we generally talk of conspiracy when the secret plan in question seems morally questionable, at least to some people. (If nobody disapproved, there would be no need to keep the plan a secret!) Retrospective rule-making has few supporters and many opponents. Defenders of retrospective laws generally do so on the basis that they are a necessary evil in specific or limited circumstances, for example to close tax loopholes, to deal with terrorists or to prosecute fallen tyrants. Yet the reality of retrospective rule making is far more widespread than this, and ranges from 'corrective' legislation to 'interpretive regulations' to judicial decision making. The search for a rational justification for retrospective rule-making necessitates a reconsideration (...) of the very nature of the rule of law and the kind of law that can rule, and will provide new insights into the nature of law and the parameters of societal order.This book examines the various ways in which laws may be seen as retrospective and analyses the problems in defining retrospectivity. In his analysis Dr Charles Sampford asserts that the definitive argument against retrospective rule-making is the expectation of individuals that, if their actions today are considered by a future court, the applicable law was discoverable at the time the action was performed. The book goes on to suggest that although the strength of this 'rule of law' argument should prevail in general, exceptions are sometimes necessary, and that there may even be occasions when analysis of the rule of law may provide the foundation for the application of retrospective laws. The three claims put forward by Dr. Roger Poisson to rationalize his enrollment of ineligible subjects in clinical trials do not justify research fraud. None the less, certain lessons for the conduct of clinical research can be learned from the affair: experimental therapies should be made available to technically ineligible subjects when no effective therapy exists for their disease; further research must investigate the possible benefits of clinical-trial participation; broadly based, pragmatic trials must be regarded as the ideal model; and (...) each eligibility criterion in a clinical-trial protocol should be justified. Professor Zenkovsky's work is a history in the grand manner --and a grand history it is. We are much indebted to Dr. George Kline for his lucid, readable translation. Our historian takes the basic theme of Russian thought to have been the relations of Christianity and secularism. This does not mean that there has been a dearth of studies in logic, philosophy of science, and so on; or that Zenkovsky neglects these or treats them unfairly or unintelligently. But his belief (...) is that "the genuinely vital creative problems of philosophic reflection derive from the Christian gospel and hence cannot be resolved apart from it." In the West, however, it has, he thinks, been difficult to see this because freedom of investigation has there become identified with opposition to the Church, while in Russia it has been possible to defend such freedom "from the religious point of view, taking the ecclesiastical tradition as point of departure, and giving oneself up fully to the 'free spontaneous force of theological investigation,' in Karsavin's familiar expression." The Russian view of the Church, as set forth by Khomyakov and Kireyevski, a hundred years ago, is not that of an "authority" wielded by officials or even councils, but of a community of members forming a spiritual organism in which they reach a level of life involving integral experience of the nature of reality. Ecclesiastical coercion, as in the West, is viewed as a heresy. Faith calls us to a life of freedom, rather than of "obedience." Zenkovsky regards as "romantic" the notion of a generally diffused spiritual insight which would make all important truths perfectly evident, but he seems to agree with the rejection of coercion.
